Application fee
Nonrefundable filing fee of 0.5% of the proposed capital expenditure, minimum $5,000 and maximum $25,000.
Moratoria
Long-standing legislative moratoria (first imposed in 1990) bar new or expanded nursing home beds, ICF and ICF/IID beds, and new home health agencies. Effective April 17, 2026, the Legislature re-enacted and reaffirmed the nursing facility / ICF / ICF-IID moratorium (HB 1622, 2026 Regular Session, §2) and the home health agency moratorium.
Recent changes
SFY 2026 review thresholds: $20,000,000 for non-clinical capital expenditures, $10,000,000 for clinical health services and $3,000,000 for major medical equipment. MSDH revised its CON application form and Review Manual in August 2026. 2026 legislation (HB 1622) re-enacted the LTC moratoria with legislative findings.
