Long-term care: $3,000 for a new CON; acquisition applications 0.5% of capital cost, maximum $5,000 (63 O.S. §1-852.1). Psychiatric / chemical dependency: 0.75% of capital cost, minimum $1,500, maximum $10,000. Partial refunds (75% / 50% / 25%) depending on when an application is withdrawn.
Review timeline
Completeness decision within 15 days of filing; applicant has 90 days to cure or the application is dismissed. Parties' evidence and argument due 20 days after the paid public notice. Decision within 15 days after that deadline for psychiatric / chemical dependency acquisitions, and within 45 days for other applications; extendable by agreement (OAC 310:4-1-5).
Recent changes
OAC Chapter 310:4 was reorganized effective September 11, 2021. It consolidated the CON standards for facility acquisitions, ICF/IID, nursing facility beds, and psychiatric and chemical dependency service beds into one chapter and added a fee formula for acquisition applications.
